Terms and Conditions

Article 1. Applicability

These General Terms and Conditions of Vistacamp apply to all services and Agreements regarding the rental of Accommodations between Traveler and Vistacamp. Vistacamp does not offer package holidays and is therefore exempt from the rules regarding package holidays.

Article 2. Definitions

Accommodation: The holiday accommodations offered by Vistacamp such as bungalows, chalets, apartments, mobile homes, safari tents, etc., and pitches for caravans/tents, etc.

Owner: The Owner of the holiday accommodations and camping places, who is often also the Owner of the campsite, the Park, or the resort.

Travel Companion: The persons registered by the Traveler at the time of booking who are part of the travel group.

Agreement: The Agreement between the Traveler and Vistacamp, whereby Vistacamp commits to providing services related to travel to the Traveler.

Park: The campsite, Park, or resort where the Accommodation is located.

Travel Amount: Basic rental costs including any Reservation Fees, any discounts, other costs, and cancellation insurance premiums, excluding on-site payable costs.

Traveler: The Client (registrant) or others than the Client on whose behalf the Client enters into an Agreement and who accepts this Agreement.

Reservation Fees: The amount charged by Vistacamp for its services.

Website: The Website used by Vistacamp to offer the Accommodations.

Business Days: Monday to Friday from 9:00 a.m. to 5:00 p.m., excluding recognized public holidays in the Netherlands.

Article 3. The reservation and Agreement

3.1 The Agreement

3.1.1 The Traveler has the opportunity to reserve an Accommodation online via Vistacamp's Website. The Traveler must ensure that the entered information is correct. The Traveler must be at least 21 years old at the time of reservation. The Traveler is jointly liable for all Travel Companions registered who accompany them. By submitting the reservation, the Traveler enters into a binding Agreement with a payment obligation.

3.1.2 After this reservation, the Traveler will receive a confirmation email that the reservation has been received by Vistacamp. Within 3 business days, the Traveler's details will be checked for correctness, and the Traveler will receive confirmation from Vistacamp that the Accommodation has been booked. This confirmation email also serves as the Agreement that has been established between the Traveler and Vistacamp. Vistacamp will not send a booking confirmation by mail.

3.1.3 If the Traveler has not received an email, something may have gone wrong with the reservation, and the Traveler should contact Vistacamp, failing which the Traveler cannot invoke the reservation.

3.2 Refusing reservation

3.2.1 There are Parks that do not accept reservations from a travel group that solely consists of young people. Vistacamp therefore reserves the right to refuse those reservations.

3.2.2 Furthermore, Vistacamp reserves the right to refuse a reservation if it is suspected that the Accommodation will be used in violation of these General Terms and Conditions.

3.2.3 Vistacamp is also free to refuse a reservation without providing reasons.

3.3 Right of withdrawal

Made bookings are legally definitive. A right of withdrawal (the so-called cooling-off period) as referred to in the Civil Code does not apply to services related to the rental of Accommodations. This means that the reservation/booking cannot be canceled free of charge by the Traveler.

Article 4. Prices and costs

4.1 Prices

4.1.1 The prices stated are per Accommodation per night, unless otherwise specified.

4.1.2 A combination of discounts is not possible.

4.1.3 Vistacamp reserves the right to change the Travel Amount if an increase in government levies or taxes necessitates this.

4.1.4 Any discount promotions do not apply to existing Agreements. It is not possible to receive a refund for the price difference.

4.2 Reservation fees

The Reservation Fees amount to €22.50 per reservation.

4.3 Other costs

These are costs for bed linen, baby cot, dog, wifi, air conditioning, etc. If these costs can be booked directly at the time of reservation, they will fall under this category. If this is not the case, they will fall under the category of costs payable on-site, see Article 4.4.

4.4 Costs on-site

Some costs must be paid on-site. Consider, for example, tourist tax. It may also happen that bed linen, wifi, or air conditioning must be paid on-site. We will provide this information on the Website as much as possible. These costs may be subject to changes due to exchange rates or local laws and regulations. Vistacamp cannot be held liable for this change.

4.5 Deposit

4.5.1 The deposit is an amount that must be paid upon arrival at the Park, as an advance for any damages caused during the stay by (the actions of) the Traveler or Travel Companion. Any contractual fines can also be settled with the deposit. The Accommodation must always be left clean and tidy.

4.5.2 If the Accommodation is left unclean or damaged, the deposit may be withheld. Vistacamp accepts no responsibility for the collection and/or refund of this deposit.

4.6 Preference

4.6.1 The preference costs are €5 per preference. A preference does not guarantee anything. No rights can be derived from the non-fulfillment of a preference. The preference costs are administrative costs and cannot be refunded afterward. Preferences regarding the Accommodations, such as location etc., must be communicated at the time of reservation.

4.6.2 Vistacamp communicates these preferences to the Park. The implementation of this cannot be guaranteed by Vistacamp.

Article 5. Invoice and payment

5.1 Payment

5.1.1 During the booking process on our website, the payment requirements for the reservation of the campsite may vary:

Option 1: A deposit of 25% of the total price is required. This payment must be completed at the time of booking.

Option 2: Full payment is required at the time of booking if the reservation is made within a specific period before the arrival date, if the reservation is non-refundable, or if required by the campsite policy.

5.1.2 For bookings requiring a deposit, the remaining amount must be paid no later than 8 weeks before the arrival date.

5.1.3 For bookings made within 8 weeks of the arrival date or in cases where full payment is required, the full amount must be paid during the booking process.

5.1.4 Payment can be made via iDEAL, as supported by our online booking system.

5.2 Failure to pay within the payment term

5.2.1 If the agreed payment terms are exceeded, Vistacamp reserves the right to cancel the reservation and hold the Traveler liable for the incurred costs.

5.2.2 In this case, the cancellation conditions will apply in accordance with Article 6.2.1 and the amounts already paid will be offset against the cancellation costs.

5.2.3 Vistacamp reserves the right to assign the claim on behalf of the Park or the Owner of the Accommodation to a third party. All related judicial and extrajudicial costs, as well as the statutory interest, will then be charged to the Traveler.

Article 6. Modification or cancellation

6.1 Changes by the Traveler

6.1.1 Modification costs are €30 per change.

6.1.2 Modification requests after the Agreement has been established can be submitted by the Traveler via email to Vistacamp.

6.1.3 If the modification of the Agreement is possible, a new calculation of the Travel Amount will be made. If the modification leads to a decrease in the Travel Amount, the cancellation costs apply to the difference. See Article 6.2.1.

6.1.4 Modification requests can be implemented up to 28 calendar days before departure.

6.1.5 Modification requests refer to: changing the number of persons; booking bed and towels; booking a baby cot; changing a Travel Companion; transferring the booking to another Traveler or family.

6.1.6 If the modification request is denied, the original Agreement remains in effect.

6.1.7 Vistacamp may within 2 business days revoke the offer, even after acceptance by the customer.

6.1.8 A change of the departure or arrival date, change of Park, change of Accommodation, or shortening of the date is considered a cancellation. See Article 6.2.

6.2 Cancellation by Traveler

The cancellation conditions may vary depending on the specific accommodation. Where a different cancellation policy applies, those terms will prevail.

6.2.1 Unless otherwise stated, the following cancellation conditions apply:

  • Up to the 42nd calendar day before departure: liable for the deposit.
  • From the 42nd to the 28th calendar day before departure: liable for 60% of the Travel Amount.
  • From the 28th calendar day to the day of departure: liable for 90% of the Travel Amount.
  • On the day of arrival or later: liable for the full Travel Amount.

6.2.2 If the cancellation conditions of the specific accommodation differ, those apply.

6.2.3 If no separate cancellation policy is stated, the terms in 6.2.1 apply.

6.2.4 To reduce possible costs, it is recommended to take out cancellation insurance. Vistacamp offers this during the booking process.

6.3 Modification or cancellation by Vistacamp

6.3.1 Any unreasonable error in pricing gives Vistacamp the right to cancel the Agreement and offer a new one.

6.3.2 Vistacamp can cancel the Agreement if the Accommodation is no longer available. Vistacamp will inform the Traveler as soon as possible and search for an alternative.

6.3.3 In case of force majeure or unforeseen circumstances, Vistacamp can terminate the reservation. Vistacamp will attempt to provide an equivalent alternative. If no suitable alternative is available, the already paid Travel Amount will be refunded without compensation.

6.3.4 Vistacamp can terminate the use of the Accommodation immediately in case of overcapacity, presence of unauthorized pets, serious disruption of the Agreement, misconduct, violation of house rules, or intentional damage.

Article 7. The trip and travel information

7.1 The trip

7.1.1 Traveling to and from the booked Accommodation is the responsibility of the Traveler and is entirely at their own expense and risk.

7.1.2 The Traveler is responsible for having the necessary documents such as passport, identity card, visas, driving license, green card, and other necessary documents.

7.1.3 The Traveler must ensure all required vaccinations for themselves and pets.

7.1.4 If the Traveler is unable to travel due to missing documents or vaccinations, this is at their own expense. Vistacamp accepts no responsibility for this.

7.2 Travel information

7.2.1 Vistacamp will provide the necessary travel documents to the Traveler no later than 10 calendar days before the arrival date.

7.2.2 For bookings made within 10 calendar days of arrival, Vistacamp will indicate when and how the travel documents will be provided.

7.3 Arrival and departure

7.3.1 The check-in and check-out times vary by Park and are stated in the travel documents.

7.3.2 In case of expected late arrival, the Traveler must inform the Owner directly. If no response is received, the Traveler should contact Vistacamp. If the Traveler is not present on time and has not reported, the booking is deemed to be canceled in accordance with Article 6.2.1.

7.3.3 In case of late arrival or early departure, the costs for the entire reserved period are due.

Article 8. The Park

8.1 Facility costs

On our Website, the Traveler can see which facilities are available. There may be costs associated with usage. Vistacamp is not liable for unexpected charges or changing costs incurred on-site.

8.2 Opening hours of facilities

Vistacamp cannot guarantee that all facilities are always open. Especially in low season, facilities may be closed. Vistacamp cannot be held liable for any changes.

Article 9. The Accommodation

9.1 Purposes

The Accommodations may only be used for holiday purposes.

9.2 Maximum allowed persons

9.2.1 Occupancy with more than the stated maximum number of persons is not allowed. The Park may deny access in this case. It is not permitted to allow visitors to stay overnight without prior approval from the Park.

9.2.2 The Owner does not accept youth without supervision.

9.2.3 The Owner reserves the right to refuse different reservations without providing reasons.

9.2.4 For group trips, prior request must be made. Some campsites do not accept groups.

9.3 Condition of the Accommodation

9.3.1 The Accommodation is made available in good condition. Defects must be reported to the Owner immediately.

9.3.2 The Traveler is obliged to treat the rented property with care, ventilate sufficiently, and leave it in broom-clean condition upon departure. Any damages must be reported and paid to the Owner before departure.

9.3.3 If the Accommodation is left unclean or damaged, the deposit may be withheld.

9.3.4 A pet may only be brought after explicit confirmation by Vistacamp. Without permission, Vistacamp has the right to terminate the Agreement immediately without refund.

9.3.5 Placing extra tents, caravans, and campers is not allowed unless otherwise agreed. See Article 6.3.4.

Article 10. Obligations

10.1 Obligations of Vistacamp

10.1.1 Vistacamp will update the information on the Website as soon as possible after receiving additional information from the Owner.

10.1.2 Vistacamp is not liable for the absence of information it did not receive from the Owner in a timely manner.

10.2 Obligations of Travelers

The Traveler and Travel Companions are obliged to duly comply with all obligations in these General Terms and Conditions and the regulations of the Park.

Article 11. Complaints

Vistacamp distinguishes between complaints made prior to the holiday and complaints made during the stay.

11.1 Complaint prior to the holiday

This includes complaints about the booking process, the Website, service, and information.

11.2 Complaint during the stay

11.2.1 Complaints about the Accommodation or the Park must first be reported to the Owner. If this does not provide a solution, the Traveler should contact Vistacamp. Vistacamp will try to resolve the complaint within 48 hours.

11.2.2 If the Traveler fails to report their complaint in a timely manner, they cannot invoke it later.

11.2.3 A complaint that has not been resolved on-site must be submitted in writing within 2 weeks after the end of the trip. Vistacamp will respond within 1 month.

Article 12. Liability

12.1 Vistacamp cannot be held liable for facilities not yet being open.

12.2 Vistacamp is not liable for loss, theft, damage, or injury caused to the Traveler for any reason.

12.3 The use of all facilities is at the Traveler's own risk.

12.4 Vistacamp is not liable for damages if the Accommodation does not meet the Traveler's requirements or wishes.

12.5 Vistacamp accepts no liability for unexpected construction activities, road works, noise nuisance, disturbances from pests, or environmental issues in the vicinity of the Accommodation.

12.6 Obvious errors or mistakes on the Website do not bind Vistacamp.

12.7 Vistacamp is not responsible for the accuracy of photographs provided by third parties.

12.8 The Traveler is deemed to be aware of local laws and regulations. Vistacamp is not responsible for the consequences of a violation thereof.

12.9 During the stay, the Traveler is liable for all damage caused to the Accommodation and inventory. The settlement will initially take place between the Owner and the Traveler.

12.10 Dutch law applies to the Agreements made based on these General Terms and Conditions.
